Cause: investigate and deal with the bloody case caused by gambling game hall

The court found that the defendant Du Wenjie, together with three others, opened a gambling game hall named "Xin Player Video Game City" on the upper floor of "Laoer Hardware" in Horqin District, Tongliao City. In front of the police station, the police saw Bao Zhan lying on his back to the north, his feet and hands twitching, exhaling with a big mouth and blood on his face. Taxi driver Bao confirmed: At about 23: 10 on July 10th, 2016, a man (verified as Du Wenjie by investigation) took a taxi in front of the Oriental Supermarket on the north side of the water conservancy filling station, and when he went to the north gate of Xinglong New Village Community, the male passenger asked to stop, and the male passenger got off and walked to the north gate of Xinglong New Village Community. About five minutes later, the male passenger returned to the car and asked to return to the vicinity of the water filling station. On the way, the male passenger called and said, "I just shot twice, so you don’t have to worry about me, and I don’t need this mobile phone." After he hung up the phone, he has been borrowing a mobile phone from the taxi driver Bao. When the taxi arrived at the bus stop at the west gate of Dongxing New City, the male passenger handed his mobile phone to Bao Mou together with Bao Mou’s mobile phone, and then gave Bao Mou 10 yuan money and said, "Master, please stop here and help me send the mobile phone to the north gate of Xinglong New Village Community, where someone answered it." The male passenger got off the bus and left.

Taxi driver Zhang confirmed: At about 23: 40 on July 10th, 2016, a male passenger (later investigated as Du Wenjie) stood on the side of the road and took a taxi. After getting on the bus, he said he would go to "Old Five Hundred" (commonly known locally, located in the east section of Mingren Street in the main city). When he went to Longting International Community, he said to go to Fuyuan Community. When he arrived at the innermost building of Fuyuan Community, he said, "Master, please wait for me for a while, and I’ll be right down." After waiting for about three minutes, the male passenger came out of the corridor and returned to the taxi, demanding to return to the "old 500". When the taxi drove to "Old 500", the male passenger said that his mobile phone was at home and he borrowed it from the taxi driver Zhang to make a phone call. Because the radio was playing in the car, Zhang didn’t hear the conversation clearly. When going to the east section of Mingren Street, someone took a taxi by the roadside and the male passenger got off here.

Taxi driver Huang confirmed: In the early morning of July 11th, 2016, he drove a taxi to the east gate of Kangfeng Jiayuan on Hongxing Road. A man (later verified as Du Wenjie by investigation) stood in the west of the road and waved a taxi. When he drove to Huolinhe Street, he made a phone call. After the first call, he said to Huang, "Master, I will trouble you for a while. The case that happened in front of the Shijie police station was my doing, which is troublesome. At this time, the man began to look at the gun barrel and said, "There are no bullets in the gun. Don’t worry, I won’t embarrass you. Everyone’s heart is full of meat." He asked Huang for a kraft paper bag, and conveniently took off the co-pilot headrest cloth cover, wrapped the gun and magazine, and let Huang drive to Horqin Street. When driving to Hanshan Hotel, he borrowed Huang’s mobile phone to make a second call and said on the phone, "I’ll find a taxi driver to send the gun." After putting down the phone, he made another call, directly asked Huang to answer the phone, and gestured with Huang, meaning to let Huang send it. Huang had to say, "Hello, I am driving a taxi, and someone asked me to send things back to you." Huang said in his testimony: "The other party asked me where I was, and the man was in the car. I dare not say where I was. The man in the car whispered that I was in the National Building, so I told the people on the phone according to what the man said. The court found that on the way to escape from the crime, Du Wenjie handed the gun to the taxi driver Huang and sent it to the former person in charge of the Horqin police station. Du Wenjie started talking to an older policeman, roughly saying that these machines are legal. Later, the people in our game hall were taken to the Shijie police station and concentrated on the second floor to make a record. At 10 o’clock in the evening, I saw Du Wenjie come to the second floor and didn’t talk to me. I haven’t seen him since. Then I heard five "bang, bang" sounds, and then I heard the screams of the car starting quickly.

One day at the end of June, 2016, the game hall was arrested twice a day by the police station, and Du Wenjie went to the police station to bail us out. He also drove a police car to send customers back to the game hall. From then on, Du Wenjie often came to the game hall, and the police car stopped downstairs. This time, when we were arrested and taken to the police station, Du Wenjie came to me at the gate of the game hall and said, "Don’t be afraid, don’t say anything there, it’s okay."

Exploration: the source of the standard pistol used by the defendant in committing the crime

According to the testimony of the Horqin Police Station, Du Wenjie is the staff of the Horqin Police Station of the Public Security Bureau of Horqin District, where he is responsible for the patrol work. On December 16, 2015, the institute went to the gun depot of the Public Security Brigade to get the gun, and the recovered Type 64 pistol was placed in the gun cabinet of the institute.
